Upon production, taken on board. 2] The learned counsel for the Petitioner submits that since the proceedings before the Trial Court have already been disposed of, technically, this petition has been rendered infructuous. However, he points out that appeal is pending before the District Court, where the issue raised in this petition has again been raised. In these circumstances, he seeks liberty to agitate the issue raised in this petition before the Appeal Court. The request is reasonable and therefore the same is granted.
3] It is made clear that all contentions of all parties are kept open to be decided by the District Court in the pending appeal.
4] This petition is therefore disposed of with liberty as aforesaid.
5] Praecipe is disposed of.
