This is a subsequent application seeking enlargement on bail in Crime No. 180 of 2017 registered at Natepute Police Station , Dist. Solapur. The earlier application was withdrawn before this Court on 22nd June, 2018 after the matter was argued at length and the Court was not inclined to grant bail. As on today there is no change in circumstance.

The learned counsel for the Applicant vehemently submits that the copy of the CA report is not annexed along with the charge-sheet and, therefore, the Applicant is entitled to be enlarged on bail.

Be that as it may, the prosecution is at liberty to file the copy of the CA report at the stage of filing of application under section 294 of Cr.P.C. or, thereafter with the permission of the Court. In any case, that cannot be a ground for enlarging the applicant on bail.

In view of this, the bail application stands rejected with a direction to the District and Sessions Judge, Malshiras seized with

2- BA 2718 of 2018 Sessions Case No. 21 of 2017 to expedite the trial as far as possible and conclude recording of evidence within ten months from the date of framing of the charge.
