Heard the learned counsel for parties. Advocate for Appellant has filed praecipe dated 1st February 2016 for permission to withdraw the present First Appeal with liberty to file appropriate application before the competent authority for regularization of the extend portion of the structure of the flat and its change of user in accordance with the provision of law. The said praecipe is taken on record and marked "X" for identification. Hence following order :- a.

First Appeal stand dismissed as withdrawn with liberty as prayed.

b.

If Application is made within 6 weeks from today the Respondent-Corporation to decide the same according to law. c.

Till that time parties are directed to maintain status-quo as on today.
