This is an application filed by the aforesaid Applicant in apprehension of his arrest in C.R. No.91 of 2015 registered with Yawat Police Station, Pune, for the offences punishable under sections 307, 353, 333, 143, 147, 148, 149, 504 and 506 of the Indian Penal Code. 2.

Heard the learned counsel for the Applicant and the learned APP for the Respondent-State.

I have perused the records and considered the submissions advanced by the learned counsel for the respective parties. The records prima facie reveal that on 4.4.2015 there was a fare at village 1/3

Nandgaon and the Applicant alongwith the co-accused had tried to disturb the programme (Tamasha) and when the police head constable and other police personnels intervened, the Applicant alongwith the co-accused assaulted them by iron rods.

The FIR prima facie indicates that the co-accused Nilesh Gund and Deepak Khaladkar were involved in inflicting injuries by iron rods. The FIR does not prima facie indicate that the Applicant was involved in inflicting any such injury on any of the police constables. Considering the nature of the allegations the Applicant is entitled for anticipatory bail.

Under the circumstances, the application is allowed on the following terms and conditions:- (I) In the event of arrest of the Applicant, in C.R. No.91 of 2015 registered with Yawat Police Station, Pune, the Applicant be released on bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand only) with one or two sureties to the like amount to the satisfaction of Judicial Magistrate, First Class, Daund.

(II) The Applicant is directed to report to the Investigating 2/3

Officer initially for a period of four days from 10.00 a.m. to 1.00 p.m. and further as and when required by the Investigating Officer for the purpose of investigation and interrogation.

(III) The Applicant shall not interfere with the complainant or any of the witnesses in any manner.
