This application is filed for quashing Case No.3401744/SS/2012, which is pending before the Additional Chief Metropolitan Magistrate, 31st Court, Vikhroli, Mumbai. It is pointed out by the learned Prosecutor that earlier Writ Petition No.4167 of 2014 was filed by M/s.Lux Industries Limited by the instructing advocate Mr.Saraogi and one advocate Satosh Sanoy has argued this matter before my Sister Judge (Justice R.P. SondurBaldota), who has by a reasoned order dated 5.2.2016, dismissed the Writ Petition and refused to grant relief. 2.
With the same prayers, this Criminal Application under section 482 is filed through the present advocate, who is instructed by Mr.Saraogi. There is no power of review in this Court. Hence, the present application 1 / 2
apl.1367.2016_5.doc is liable to be dismissed. At this stage, the learned Counsel sought permission to withdraw the petition, however, the permission is refused and the application is dismissed.
