1) The applicant is seeking bail in CR No. 302/2015 dated 17.7.2015 registered with Nagpada Police Station under sections 376, 370 (3), 343 read with section 34 of the IPC and under sections 4, 5, 6 of the Immoral Traffic (Prevention) Act.
2) It is the prosecution case that on 16.7.2015 the police from Social Service Branch conducted a raid on a brothel on receipt of a specific information. At that time, one of the victim lady by name Smt. Vasanti Mandal was stealthily removed from the said place by the other accused persons and was lodged at a place, bearing room No.12. It is the further prosecution case that, whenever the said victim lady Smt. Vasanti Mandal wanted to move out of the said room, the applicant and other co-accused
2 /3 53-BA-2291-2015.doc persons obstructed her by confining her movements. The applicant and other accused persons round the cloak, used to guard the said room. In the premise the FIR was lodged.
3) The learned counsel for the applicant submitted that the coaccused namely Raju Anthony Crasto has been released on bail by the learned trial Court by its order dated 30.12.2015. She further submitted that the role attributed to the present applicant and Raju Anthony is same and similar. The learned APP conceded to the said submission. The learned APP submitted that there are no antecedents at the discredit of the applicant.
4) In view of the above, the principle of parity is applicable to the present applicant and, therefore, the applicant is entitled to be released on bail.
5) Hence, the following order :
ORDER:- (a) The applicant shall be released on bail in CR No. 302/2015 registered with Nagpada Police Station, Mumbai on his furnishing a P.R. bond of Rs.30,000/- with two local sureties in the like amount;
(b) After release from jail, the applicant shall attend each and every date before the trial Court. The applicant shall co-operate with the Court for expeditious disposal of the trial;
(c) The applicant shall furnish his permanent
3 /3 53-BA-2291-2015.doc residential address and shall not change his residence without prior intimation to Senior P.I. of the concerned Police station;
(d) The applicant shall not directly or indirectly make any inducement, threat or pressurise any prosecution witnesses and shall not in any manner tamper with the prosecution evidence;
(e) The applicant shall attend Nagpada Police station on every Tuesday until further orders by the Trial Court;
(f) Breach of any conditions by the applicant may result in cancellation of bail;
