By this application the applicant seeks condonation of 20 days delay in filing the civil application and seeks restoration of the second appeal along with civil application which are dismissed for default by an order dated 21st September, 2015. Learned advocate appearing for the applicant had filed a leave note on the date when the matter appeared before this Court on 21st September, 2015. 2.

Learned counsel for the respondents have no objection if this civil application is allowed. For the reasons recorded in the civil application, the civil application is made absolute in terms of prayer clauses (a) and (b).
