Heard. By this Civil Application, the Applicant is seeking restoration of the First Appeal which stood dismissed in view of conditional order dated 24.01.2017 passed by this court (Coram : M. S. Sonak, J.) for non filing of paper book within time.

The learned AGP submits that inadvertently it remained on their part to file private paper book within time. He submits that the Applicant undertakes to file paper book within a week. The statement is accepted.

50.1999.19-caf.doc the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) The First Appeal is restored to file for hearing on merits.

b) Time to comply with order dated 24.01.2017 is extended till 29.06.2019.

c) Civil application stands disposed off accordingly.
