The Learned Counsel for the Appellant Mr. Suresh Dubey tenders the affidavit of the Appellant Mr. Rajiv Bhagwan Kerkar dated 04.07.2016. In paragraph 3 of the said affidavit, the affiant has stated that he wants to withdraw the above Appeal from Order as well as the suit as the prayer in the suit and Appeal from Order has been answered. The Appellant Mr. Rajiv Bhagwan Kerkar is also personally present in Court and he is identified by Mr. Suresh Dubey and has also produced his Aadhar Card. On being put in the box and queried, the Appellant BGP.

(905)-AO-1176-15.doc reiterates what has been stated in the said affidavit and states that he desires to withdraw the above Appeal from Order and also the suit. The affidavit of Appellant is taken on record. In view thereof, the Appeal from Order is allowed to be withdrawn and dismissed as such. In view of the withdrawal of the above Appeal from order, the Civil Application does not survive and to accordingly stand disposed of. The Appellant may move the Trial Court for withdrawal of the suit along with a copy of this order.
