This is an Application filed under Section 407 of the Code of Criminal Procedure, 1973, seeking the transfer of S.C.C. No.57 of 2022 pending before the learned 2nd C.J.J.D. and Judicial Magistrate First Class, Mahad, Raigad to the learned Judicial Magistrate First Class at Pune.

This matter was called out in the morning session. However, as none appeared in the morning session, the same was kept back in the afternoon session. In the afternoon session also none appears for the Applicant.

The offence involved in the said criminal case is under

26-APPLN-19-2024.doc Section 138 of the Negotiable Instruments Act, 1881. The only ground is that the Applicant is a resident of Pune. The said case is filed at Mahad and travelling time from Pune to Mahad is approximately 3.30 hours. Accordingly, no case is made out for transfer.

The Criminal Application is dismissed.
