After arguing for some time, the learned Counsel for the applicant upon instructions seeks liberty to withdraw the application. The liberty as prayed for is granted in the interest of justice. It is made clear that the investigation is in progress and the applicant may file an application under section 439 of the Code of Criminal Procedure, 1973, after filing of the charge-sheet. Hence, the application stands dismissed as withdrawn and disposed of accordingly.
