These are applications under Section 438 of Cr.P.C. filed by the aforesaid Applicants apprehending their arrest in C.R. No. 100 of 2018 registered with the Naupada Police Station, Thane, for offences punishable under Sections 406 and 420 r/w 34 of the IPC. 2.
Heard Mr. Mankapure and Mr. Upadhyay, learned counsel for 1/3
the Applicants and Ms A.A. Takalkar, learned APP for Respondent -State. Perused the records and considered the submissions advanced by the learned counsel for the respective parties.

The aforesaid crime was registered pursuant to the FIR lodged by Mr. Ashok Omprakash Chaudhari, one of the Directors of M/s. Sonu Kargo Movers India Pvt. Ltd. The Applicants herein were employed in the said Company. It is stated that the Applicants herein had misappropriated around 1331 metric ton of onion worth Rs.2,26,27,000/-. These Applicants are on interim bail since the year 2018. They have reported to the investigating agency and have been duly interrogated. Learned APP states that the investigation has been completed and that the charge sheet will be filed within a period of two weeks. Presence of the Applicants is not required for custodial interrogation.

Hence, the applications are allowed on the following terms and conditions:- (i) In the event of arrest of the Applicants in C.R. No. 100 of 2018 registered with the Naupada Police Station, Thane, the Applicants shall be released on bail on executing PR bonds in the sum of 2/3
Rs.30,000/- each with one or two sureties each to the like amount ;
(ii) The Applicants shall report to the concerned Investigating Officer as and when required by the Investigating Officer;
(iii) The Applicants shall keep the Investigating Officer their current addresses and mobile contact numbers, and /or change of residence or mobile details, if any from time to time.

The applications stand disposed of.
