1] This is an application for temporary bail.

2] The applicants came to be arrested in C.R. No. 303 of 2019 registered at Kharghar Police Station, Navi Mumbai for the ofences punishable under Sections 406, 409, 420, 120B,, 34 of the Indian Penal Code and Sections 3 and 4 of the M.P.I.D. Act. 3] The applicant No.1 B Satyavan Keni, in the present application, is also the accused in C.R. No. 70 of 2019 registered at Roha Police Station for the ofences punishable under Sections 420, 406, 409, 467, 468, 471, 420(,) of the IPC and Sections 3 and 4 of the M.P.I.D. Act.

4] The temporary bail is sought on the ground that the mother of applicants has expired on 15 November 2022. 1/3

2/3 5] The learned Session Judge, MangaonBRaigad has released the applicant No.1 Satyavan Keni on interim bail for a period of four weeks on the very same ground in C.R. No. 70 of 2019. 6] The learned counsel for the applicants submits that the applicants before approaching this Court have approached the Sessions Court, Panvel and fled the application in present crime for temporary bail, however, no order is passed and it is adjourned to 18 November 2022. It is submitted that the post death rituals are required to be performed by the present applicants and today they have to perform third day rituals and therefore, the applicants are constrained to approach this Court. Considering the fact and circumstances, I am inclined to release the applicant on bail for a period of two weeks. In the result, the following order is passed:

O R D E R

A] Application is allowed.

,] The applicants be released on cash bail of Rs.25,000/B (Rupees Twenty Five Thousand) each in C.R. No. 303 of 2019 registered at Kharghar Police Station, Navi Mumbai for the ofences punishable under Sections 406, 409, 420, 120B,, 34 of the IPC and Sections 3 and 4 of the M.P.I.D. Act. for a period of two weeks from today.

3/3 C] During the said period of two weeks, the applicants shall attend the Kharghar Police Station on every alternate day between 11:00 a.m. to 2:00 p.m.

D] All concerned to act on authenticated copy of this order.
