It is an application for condonation of delay of 55 days occurred in filing appeal against the judgment and decree dated 3rd May, 2017 passed in Regular Civil Appeal No.168 of 2014. Heard learned counsel for parties.
Respondent has opposed this application vehemently contending that the reasons set out in paragraph 7 of the application are not disclosing the sufficient cause for condoning the delay. This appeal is preferred by the trust. It is stated in paragraph 7 that they had received certified copy on 25th May, 2017 Shivgan 1/2
912-CAS-1292-2018.odt and approached advocate practising in the High Court in June, 2017. Draft prepared by the advocate was not to the satisfaction of the applicant and thus, trust has approached another lawyer. It is in these circumstances, delay is occurred in presenting the appeal. In my view, sufficient cause is shown for condoning the delay. Application is allowed in terms of prayer clause (b). Application is disposed of in the above terms.
