Heard Mr. Patil, learned Advocate for Petitioner appearing for the Petitioner - Employee and Mr. Alai, learned Advocate for Respondent.

Writ Petition takes exception to the interlocutory order passed below Exhibit U-2 dated 28.06.2017 in Reference (IDA) No.63 of 2016 refusing interim relief to the Petitioner. With the able assistance of the learned Advocates, I have perused the impugned order as also the pleadings.

After I expressed my mind to dismiss the Writ Petition, learned Advocate appearing for Petitioner would submit that in that event an appropriate direction be given to the First Labour Court, Thane where Reference (IDA) No.63 of 2016 is pending since 2016 to

13.WP.13756.2023.doc dispose of the same within a time bound programme. To that extent, I am inclined to pass that direction.

Hence, it is directed that the First Labour Court, Thane shall complete hearing and decision in Reference (IDA) No.63 of 2016 within a period of four months from today. Petitioner and Respondent - Company are both directed to appear before the First Labour Court, Thane on 20.11.2023 at 12.00 noon alongwith an authenticated copy of this order so as to enable the learned Labour Court to draw the schedule of hearing of Reference (IDA) No.63 of 2016 and complete the same.

Needless to state that this Court has not opined on merits of the matter and all contentions of both parties are expressly kept open. 6.
