It is informed by the learned A.P.P. that considering the nature of accusations levelled in C.R.No.586 of 2022 registered with Nayanagar Police Station, Mira Road, Thane, the applicant was issued with the notice under Section 41A of Cr.P.C., but there is no compliance.

Learned counsel for the applicant states that the applicant shall abide by the said notice, by reporting to the Investigating Offcer within a period of 7 days from today. Upon his appearance, the Investigating Offcer shall follow the mandate set out under Section 41A of Cr.P.C. and M.M.Salgaonkar

2/2 906 ABA-3210-22.doc shall record reasons in writing, in case, he comes to the conclusion that the arrest is necessary. Before effecting the arrest for the purpose of custodial interrogation, he shall serve 72 hours notice to the applicant.
