Learned counsel Mr.Talkute, appearing for Respondent Nos.1 and 2, has circulated the Writ Petition for its disposal in light of the order dated 01/07/2021 passed by the learned Civil Judge, Senior Division, Pune, recording that Suit is permitted to be withdrawn unconditionally in the background of the compromise arrived with the contesting defendants. 2.
The present Writ Petition is instituted challenging the order passed below Exh.99 in the very same Suit whereby the M.M.Salgaonkar
2/2 3 WP-13980-18.doc application preferred to withdraw the Suit with liberty to fle afresh, was rejected on 20/07/2018. In the wake of the Civil Suit, in which this application was preferred itself being disposed of as withdrawn, nothing remains in the present Writ Petition to adjudicate and, therefore, it has to be necessarily disposed of as being rendered infructuous in view of the disposal of the Suit.

The Writ Petition as well as Interim Application stand disposed of.
