This petition takes exception to the interim order dated 31st October,2017 passed by the respondent no.14 in pending Appeal/Revision Appeal No.854 of 2017 (Shri Suresh Tiwari vs. Panchsheel S.R.A. Co.op. Hsg. Society Ltd.,Mumbai). It appears that the respondent no.14 by the impugned order has stayed the order dated 11th September, 2017 passed by the respondent no.12. The impugned order itself has been passed on 31st October,2017. In that view of the matter, ends of justice would be met with in case the respondent no.14 is directed to decide the pending aforesaid proceeding, if already not decided, within the stipulated period.

In the light of above, the petition is disposed of with a direction

kvm 2/2 8-WP571.19 to the respondent no.14 to decide the aforesaid pending proceeding, if already not decided, as expeditiously as possible however within eight weeks from today.

Needless to observe that the respondent no.14 shall afford reasonable opportunity of hearing to the parties. 4.

This court has not expressed opinion on merits and all the contentions raised on merits in the present petition and also by the respondents are kept open for being agitated before the respondent no.14. It is for the respondent no.14 to take appropriate decision in accordance with law.
