Mr. Patil, learned Counsel appearing for the Petitioner after arguing the matter for some time states that if the directions are given to the Additional Divisional Commissioner, Pune Division, Pune to decide Appeal No. 10 of 2023 pending before him, within time bound manner, then he has instructions to withdraw the Writ Petition.

Mr. Sawant, learned AGP, on instructions, states that on 26th October 2023, the Additional Divisional Commissioner, Pune Division, Pune will give hearing to the Petitioner as well as the 1/2

Mr. Patil, learned Counsel appearing for the Petitioner states that the Petitioner will give notice to the Respondent No. 1 informing him about the date i.e. 26th October 2023 of hearing before the Additional Divisional Commissioner, Pune Division, Pune and he will file an affidavit of service before the Additional Divisional Commissioner, Pune Division, Pune on 26th October 2023.

Learned Additional Divisional Commissioner, Pune Division, Pune is requested to dispose of the said Appeal No.10 of 2023 on or before 30th October 2023.

Accordingly, the Writ Petition is allowed to withdrawn and disposed of, however, subject to above.
