Heard learned counsel (appointed) and learned APP for the State. The communication dated 06/11/2019 sent by the Superintendent, Yerawada Central Prison to the office of the PP is taken on record as Exh. "A".

The prisoner claims on false implication in some quarrel at Yerawada Central Prison and his unnecessary shifting to Nashik Road Central Prison.

After hearing respective counsel and after perusal of the above mentioned report and its annexures, we are satisfied that the prisoner was shifted to Nashik Road Central Prison as video conferencing facility was functioning at Nashik. After the said nilegaonkar 1/2

8-wp-5536.2019.odt purpose was achieved, he has been brought back to Yerawada Central Prison on 11/1/2020. With the result, the contention that he has been unnecessarily transferred to other prison is ill founded.

In so far as false implication is concerned, learned APP upon instructions states that as yet no adverse action has been taken against the present prisoner in the matter. We therefore, find the grievance premature. We keep it open and with a liberty to the prisoner to raise it at appropriate juncture, we dispose of the writ petition.
