This is an application for anticipatory bail in connection with CR No.675 of 2018 registered with Chatushrungi Police Station, Pune for offences under Sections 408 of IPC.

The case of the prosecution is that during the period of 3.12.2018 and 25.12.2018 the informant had deposited Rs.2,71,649/- in the account of applicant for the wages and expenses of labour. The said amount was allegedly misappropriated by the applicant. Hence, the FIR was lodged on 30-12-2018. 3.

Learned advocate for the applicant submitted that the bank account of the applicant was attached during the course of investigation and the amount more than the appropriated amount is lying in the bank accounts. Learned APP on instructions submits that two bank accounts of the applicant were attached viz Punjab National Bank and Canara Bank. In Canara Bank account amount of Rs.2,31,316/- and in Punjab National Bank amount of Rs.75,665/- is

2 of 2 927.ABA.2378.2019.doc lying. In the circumstances, the custodial interrogation of the applicant is not warranted and relief as prayed can be granted on certain terms and conditions.

Hence, I pass following order :

ORDER

(i) In the event of arrest of applicant in connection with CR No.675 of 2018 registered with Chatushrungi Police Station, Pune, the applicant may be released on bail on his furnishing PR bond in the sum of Rs.25,000/- with one or more sureties in the like amount; (ii) The applicant shall report the Investigating Officer from 2-122019 to 5-12-2019 between 10 am and 12 noon; (iii) The applicant shall co-operate in the investigation; (iv) The applicant shall furnish details of his residence to the Investigating Officer;

(v) Criminal Anticipatory Bail Application No.2378 of 2019 is disposed of.
