By this civil application, the applicant seeks condonation of delay in filing the first appeal. Leaned counsel for the applicant states that all the respondents are served. None appears for the respondent no.7. No affidavit-in-reply is filed by any of the respondents though served. 2.
Learned counsel for the respondent nos.1 to 6 submits that delay of 65 days is not sufficiently explained in the civil application. 3.
I have perused the averments made in the civil application. Delay in filing the first appeal is explained in civil application and more particularly in paragraphs 5 to 11 of the civil application. The reasons
ppn 2 48.caf-957.18.doc recorded in the civil application are accepted. There is no merit in the submission of the learned counsel for the respondent nos.1 to 6. 4.
Civil application is made absolute in terms of prayer clause (a). No order as to costs. If there are any other office objections, the same shall be removed within two weeks from today. 5.
Place the first appeal on board for 'Admission' on 11th December 2019.
