Heard Ms.Savita Ganoo, learned counsel for the petitioner, Mr. Sandip Babar, learned A.G.P for respondent no.1 and Ms. Prabha Badadare, learned counsel for respondent no.2. 2.

Learned A.G.P has tendered photocopy of communication dated 9.12.2016 which is taken on record and marked "X" for identification. In that communication, it is recorded that defendant no.1 does not press objections raised to the Commissioner's report and will be content by cross examining the Court Commissioner in that regard. Ms. Badadare, learned counsel for respondent no.2 also states that defendant no.2 will not press the objections raised to the Court Commissioner's report and will be content by cross examining the Court Commissioner. Statements of respondents no. 1 and 2 are accepted.

In view of the statements made by the learned counsel for the respondents, no further orders are necessary. Defendants no.1 and 2 will be at liberty to cross examine the Court Commissioner and their objections stand disposed of as not pressed. Petition is disposed of. Order accordingly. (R.G.KETKAR, J.)
