Heard the learned counsel for the applicant and the learned APP for the State.

By an order dated 18th October, 2023 this Court has granted interim bail.

The learned counsel for the applicant submits that pursuant to the aforesaid order the applicant has appeared before the investigating officer and cooperated in the investigation. 4.

The learned APP on instruction from the investigating officer concurs with the aforesaid statement.

This Court was persuaded to exercise the discretion in favour of the applicant as prima facie it appeared that there was a free fight between two groups over the dispute arising out of calling off Vishal Parekar ...1

46-aba-2900-2023.doc the marriage between the girl and boy from the rival group. In respect of the very same occurrence, a counter version was reported by the member of the applicant party vide C.R. No. 210 of 2023 for the offences punishable under sections 143, 147, 323, 324, 326, 504, 506(2) read with 149 of the Code.

In the aforesaid view of the matter, I am inclined to make the order of interim bail absolute.

The order of interim bail dated 18th October, 2023 is made absolute on the terms and conditions incorporated therein. 8.

In addition, the applicant shall regularly attend the proceedings before the jurisdictional Court.

It is clarified that these prima facie observations are confined to determine entitlement to pre-arrest bail only. Application disposed.
