---- CORAM : B. P. DHARMADHIKARI & SARANG V. KOTWAL, JJ.

DATE : 26/11/2018.

P.C.:

.

We appreciate the efforts made by learned counsel to persuade us to order expeditious disposal of CC No.397/PW/16. We have also perused the mode and manner in which evidence has been recorded in piecemeal on various dates. The earlier order of this Court dated 17/1/2018 in Writ Petition No.4887/2017 also expedites the same. However during argument we find that order of further investigation has been passed by the Trial Court on an application presented to it and challenge to that order is pending now in the Sessions Court. 2.

In this jurisdiction we cannot examine the validity or otherwise of that order.

3.

Hence the prayer of petitioner can be looked into only after suitable orders are passed by Session's Court in matter pending before it.

We dispose of the present petition with liberty to the petitioner to approach this Court after those orders are passed by the Sessions Court. (SARANG V. KOTWAL, J.) (B. P. DHARMADHIKARI, J.)
