This is an application preferred under Section 438 of Cr.P.C. The applicant has preferred this application directly before this Court without moving such application before Special Court. Learned Counsel for the applicant seeks permission to withdraw this Application with liberty to prefer an application before the Special Court. In view of submission, application is allowed to be withdrawn with liberty to prefer application before Special Court. All the issues including issue with regards to maintainability of application are kept open.
rpa 2/2 42-aba-2389-19.doc Since the protection granted by the Apex Court vide order dated 15th October, 2019, passed in Special Leave to Appeal (Criminal) No.8862 of 2019 is granted for four weeks, it is expected that the Special Court would decide the application, as expeditiously as possible. Learned Special Prosecutor, on instructions from the oficer who is present in Court submits that in the event the application as stated above is fled and served upon prosecution, they would proceed with matter and would not seek adjournment. Anticipatory bail application stands disposed of.
