We have heard both sides.

After perusing the petition and the annexures thereto, we inquired with Mr. Walve as to when the respondents will deal with and dispose of the application seeking refund and he sought time to take instructions on the earlier occasion. On his request, the matter was posted today. Today, Mr. Walve on seeking instructions from the concerned official, makes a statement that the application seeking refund made by the petitioner, would be disposed of as expeditiously as possible and in any SQ Pathan 1/2

wp.12394.17.908.doc event, within a period of six weeks from today. The amounts are stated in the applications at Exhibits `D' and `E'. The necessary and requisite directions in relation to refund of this amount would be passed within the above period, is the assurance given to the Court. The statements are accepted as undertakings to this Court.

In view thereof, nothing survives in the writ petition and it is disposed of.
