The learned APP, upon instructions, submits that in the present case, the Special Court (MCOC) has recorded the substantive evidence of three witnesses. The pendency of this application shall not be an impediment to proceed with the MCOC Special Case No.9 of 2013. At this stage, it would not be appropriate to consider the application under Section 439 of Cr.P.C. and hence the application stands disposed of. However, the learned Special Court seized with MCOCA Special Case No.9 of 2013 is hereby requested to make an endeavour to expedite the trial, as far as possible. Application stands disposed of.
