IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION BAIL APPLICATION NO.2332 OF 2016 Anil Vithalrao Gulgule ....

Applicant Vs.

The State of Maharashtra ....

Respondent Ms. Swapna Kode i/by Zeus Zend, Advocate for the applicant. Smt. N.S. Jain, APP for the State.

Coram : N.W. SAMBRE, J.

Date : 21st December, 2016 P.C.

The applicant is seeking regular bail in C.R. No. I-34 of 2016, registered with Chitalsar Manpada Police Station, for the offences punishable under Sections 354 of Indian Penal Code and Sections 11 and 12 of POCSO Act.

The applicant came to be arrested on 27th October, 2016.

The applicant was subjected to custodial interrogation and is a senior citizen aged about 72 years. Looking to the nature of the allegations in the F.I.R., in my opinion, no purpose would be served by ordering further

Dusane 2/2 ba2332.2016 detention of the applicant in jail. In view thereof, in my opinion, the application needs to be allowed. The applicant be released on bail by furnishing P.R. bond of Rs.25,000/- (Rupees Twenty Five Thousand only) with one or two sureties in the like amount.

Any three consecutive absence of the applicant before the learned trial court will entail the learned Judge to take out proceedings for cancellation of bail. The applicant not to tamper with the evidence and/ or influence the witnesses in any manner whatsoever. (N.W. SAMBRE, J.)
