The Petitioner is Respondent No.2 in Original Application No.1130 of 2023 filed by Respondent No.3 herein, that is, Shri Sumant Ganpatrao More. Shri Sumant Ganpatrao More in his Original Application has sought certain reliefs regarding his transfer. The Maharashtra Administrative Tribunal (the Tribunal), Mumbai in the Original Application issued notice to the Petitioner being Respondent therein.

It is the grievance of the Petitioner that even after notice was served and the Petitioner appeared, interim relief granted in the

Trupti 2 14-wp-13096-2023.doc Original Application is being continued and the proceedings are being adjourned at the request of the State Government. The learned Counsel for the Petitioner makes a grievance that the Petitioner is without posting and is seriously affected because the continuation of the interim relief.

However, as of today, we do not find that the Tribunal has confirmed the order after hearing the version of the Petitioner. On 10 October 2023, when the matter came up before the Tribunal, the objection of the Petitioner for continuation of the interim relief was noted and the matter was adjourned on 26 October 2023. The Petition is entirely premature and needless. Therefore, at this stage, we are not inclined to interfere.

We have no doubt that on 26 October 2023, when the Tribunal will take up the proceedings, it will consider the Petitioner's version and then pass necessary orders as per law. Since we have not issued notice to Respondent No.3 in this Petition, while we dispose of the Petition, we keep all contentions of the parties open. (MANJUSHA DESHPANDE, J.) (NITIN JAMDAR, J.)
