The order impugned is one allowing the Defendant i.e. the Bank of India to file its written statement on imposition of costs of Rs.2000/-. The Trial Court has recorded cogent reasons as to why the Defendant-Bank should be allowed to file its written statement. Having regard to the said reasons, no case for interference is made out. The above Writ Petition is accordingly dismissed. However, in the facts and circumstances of the present case the hearing of the Special Civil Suit No.430 of 2004 is expedited. [R.M.SAVANT, J] lgc
