The applicant was served with the notice under Section 41-A of Cr.P.C. in connection with C.R.No.856 of 2022 and he was asked to report to the Investigating Offcer, as the offence invoked is under Sections 354, 420 of IPC, for which the punishment prescribed is less than seven years. However, the applicant has not reported to the Investigating Offcer. 2.

Leaned counsel for the applicant categorically states that the applicant shall report to the Investigating Offcer within a period of three days from today.

Upon his appearance, the Investigating Offcer shall follow the mandate set out under Section 41-A of Cr.P.C. and M.M.Salgaonkar

2/2 909 ABA-3214-22.doc shall record reasons in writing, in case, he comes to the conclusion that the arrest is necessary. Before effecting the arrest for the purpose of custodial interrogation, he shall serve 72 hours notice to the applicant.
