The above Civil Application has been filed seeking condonation of delay of 212 days in filing the above First Appeal. The Applicants are the heirs of the deceased. Their application for compensation under the Workmen Compensation Act has been dismissed by the Commissioner for Workmen Compensation.

The reasons for the delay are mentioned in paragraphs 2 and 3 of the Civil Application. The sum and substance of the reasons is that the Applicant No.1 after the death of her husband did not have the financial wherewithal to take steps to file the Appeal. lgc

In my view, having regard to the aforesaid reason, case for exercise of discretion is made out. The above Civil Application is accordingly allowed.
