Heard the learned Counsel for the Applicant. Though, the respondents are served no one appeared on behalf of them, when the matter called out.

This Application is preferred by the Appellant for restoration of the First Appeal No.982 of 2012 which was dismissed in view of conditional order dated 11th October, 2012 passed by this Court for non filing of private paper book.

The learned Counsel for the Applicant submits that Applicant undertakes to file private paper book within 6 weeks from today.

Considering the submissions made by the learned Counsel for the Applicant, averments made in the Civil Application and as the Applicant undertakes to file the private paper book within 6 weeks from today, I satisfied that the Applicant has made out a case for allowing the Civil Application. Hence following order; a) First Appeal No.982 of 2012 is restored on file for hearing on its own merits.

b) Time is extended to comply the order dated 11th October, 2012 till 30th April, 2016, failing which the Civil Application shall stands dismissed without further referring back to the Court.

c) Civil Application stands disposed of accordingly. (K.K. TATED, J.) 2/2
