Heard Mr. Punde, learned counsel for the petitioner, Mrs. Deshmukh, APP for the State and Mr. Hegde, learned counsel for respondent No.3.

Perused the copy of the FIR, which is annexed at page 22 of the petition. Perusal of the same, reveals that STD Booth No.2 was given to the petitioner on license basis and this license expired on 31 st October, 2012. The petitioner was served with the notice to give the possession of the said booth. The petitioner did not comply with this notice and, therefore, the said booth was sealed by the officer of respondent No.3. The FIR further reveals that the petitioner broke open Shubhada S Kadam 1/2

Sr.No. 5 Apl 1225.14 the seal and the lock which was put on the said booth and, by opening the shutter of the booth, illegally entered the same. We, therefore, are of the prima facie opinion that the offence does disclose commission of cognizable offence. The petition is without any merit and, accordingly, stands dismissed.
