The learned counsel for the applicant submitted that the conditional order dated 21st January, 2010 in respect of dismissal of Appeal be recalled. He further submitted that the paper book is ready and he will file it within two weeks.

In view of this submission, the order of dismissal of First Appeal is hereby recalled. The First Appeal is restored to its file along with all the orders. The appellant shall file paper book on or before 16th September, 2017. If the paper book is not filed within the stipulated time, the First Appeal will be dismissed without further referring to the Court.
