1) Heard the learned counsel for the applicant. This is an appeal preferred through jail by the appellant-applicant/original accused no.1 along with an application for condonation of delay of ten days in preferring appeal through jail. The appellant has also prayed to release him on bail during pendency of the appeal. The appellant accused no.1 is in jail custody at Kolhapur Central Prison, Kalamba, Kolhapur.

10-APPA-1450-2015.doc 2) Original accused no.2 Sunil Gopal Kamble is acquitted of the offence under section 109 read with section 376 of IPC. 3) The application for condonation of delay is allowed and same is accordingly disposed of. The appeal is admitted. Call for R and P. expeditiously.

4) As the present appeal is preferred through jail and nobody is representing the appellant-accused no.1, learned counsel Mr Satyavrat Joshi is requested to represent the appellant who is present in the Court. He has accepted the request. Office to appoint Shri Satyavrat Joshi under legal aid scheme to represent the appellant in this appeal. 5) Office to give inspection of the R and P to the appointed learned counsel for the appellant and also to provide copies of appeal memo and the impugned judgment and order. 6) Stand over to 12.1.2016.
