This is an Application for condonation of delay of 266 days occurred in filing the above Appeal.

The above Appeal is filed against the Judgment and Order dated 14.10.2015 passed by the learned Addl. Sessions Judge, Greater Mumbai in Cri. Appeal No.791 of 2013, by which the Applicant was convicted for the offence punishable under Section 302 r/w.34 of the Indian Penal Code and sentenced to suffer life imprisonment. Since the Appeal arises out of the order of conviction coupled with the fact that the Applicant has explained the delay by making averments in para 5 of the Application, we condone the said delay.

Accordingly, the Application is allowed in terms of prayer clause (a). Registry is directed to number the Appeal and place it on 19.12.2016.
