This is an application for anticipatory bail in connection with CR No.I-327 of 2019 registered with Kharghar Police Station, Navi Mumbai for offences under Sections 376, 328, 506 r/w 34 of Indian Penal Code.

The FIR was registered on 30th August 2019. The victim is major. It is alleged that on the representations being made by the applicant to the family of the victim, the accused no.1 was contacted by the victim's family for performing certain rituals. It is alleged that the accused no.1 had sexually assaulted the victim on several occasions. Apparently the accused no.1 is arrested and he is in custody. The only role which is assigned to the applicant is that she has introduced the accused no.1 to the family of the victim. The role of sexual assault is attributed to accused no.1 who is already in custody.

Taking into consideration aforesaid circumstances, the custodial interrogation of the applicant is not necessary. The

2 of 2 909.ABA.2405.2019.doc applicant can be directed to co-operate with the investigation by attending the police station.

Hence, I pass following order :

ORDER

(i) In the event of arrest of applicant in CR No.I-327 of 2019 registered with Kharghar Police Station, Navi Mumbai, the applicant be released on bail on furnishing PR bond in the sum of Rs.20,000/- with one or more sureties in the lime amount; (ii) The applicant shall attend the Investigating Officer between 13th to 15th November 2019 between 10 am to 12 noon and thereafter as and when called for till filing of charge sheet; (iii) The applicant shall not contact the complainant or any other witnesses;

(iv) Criminal Anticipatory Bail Application No.2405 of 2019 is disposed of.
