Heard Mr.P.M.Bhagat, learned Counsel for the applicant.

This is an application for recalling order dated 15/01/2014 passed by the learned Registrar (Judicial - I) for restoration of the Civil Application No. 1828 of 2013 after condoning the delay in filing the application.

Mr.Bhagat states that matter was dismissed for not-effecting service to the respondent. He submitted that respondent keeps on changing his address and therefore, within stipulated period, service could not be effected. He further submitted that in addition to the address given in the cause

10.caw.115.15 title, notice may be issued to the respondent on following address.

4. In view thereof and for the reasons stated in the application, Civil Application is allowed in terms of prayer clauses (a) & (b) with no order as to costs.
