The suit as filed originally was in this court. With the increase in the pecuniary jurisdiction of the Bombay City Civil Court, it was transferred to that court. The applicant as since filed the counter-claim, value of which is beyond pecuniary jurisdiction of the Bombay City Civil Court. Heard the counsel. Perused the application. In the facts of the case the application is allowed in terms of prayer clause (B).
