The learned APP has tendered affidavit of concerned investigating officer. The same is taken on record. For the reasons stated in the affidavit bailable warrant issued against concerned investigating officer by order dated 19 December 2022 is hereby recalled.

This is an application under Section 438 of the Code of Criminal Procedure for bail.

The applicant is apprehending her arrest in Crime No. 416 of 2022 registered at Sangavi police station for the offences punishable under Sections 364-A, 504, 506 read with 34 of the Indian Penal Code. 4.

I have perused the First Information Report. There appears to be financial transactions between the parties. According to the complainant, on 12 September 2022, the present applicant came to her house alongwith three unknown persons. She quarreled with her and made her to sit on her two wheeler. While she was being forcibly taken away, she jumped from the running vehicle. She went to the police station and lodged the complaint. However, it appears that no cognizance of it was taken. According to the complainant, one more incident took place on 13 September 2022. However, the report came to be lodged only on 14 September 2022. There are no other criminal antecedents. Considering the overall facts and circumstances, I am inclined to release the applicant on anticipatory bail. Hence, the following order is passed: (i) Application is allowed.

(ii) In the even of arrest of the applicant in Crime No. 416 of 2022 registered at Sangavi police station for the offences punishable under Sections 364-A, 504, 506 read with 34 of the Indian Penal Code, she shall Digitally signed by MANGALTAI JAYWANT JADHAV Date:

2023.01.20 14:14:16 +0530 be released on anticipatory bail on furnishing PR bond in the sum of Rs. MANGALTAI JAYWANT JADHAV 25,000/- with one or two sureties in the like amount. (iii) The applicant shall attend the concerned police station from 23 January 2023 to 25 January 2023 and shall co-operate in the investigation.
