By this Petition under Article 227 of the Constitution of India, petitioner, hereinafter referred to as 'defendant No.3', has challenged the judgment and order dated 11.11.2016 passed by the learned 2nd Joint Civil Judge Junior Division, Ratnagiri below exhibit 167 in Regular Civil Suit No.19 of 2009. By that order, the learned trial Judge rejected the application made by the defendant No.3 for filing written statement.

The matter was heard at length on 09.12.2016 and was kept today for passing order.

Mr. Chandratre states that Constituted Attorney of petitioner Mr. Prabhakar Shankar Shivalkar is present in the Court. He has tendered photocopy of his Aadhar Card, which is taken on record and marked 'X' for identification. Upon taking instructions from the Constituted Attorney of the petitioner, Mr. Chandratre seeks permission to withdraw the Petition.

On the motion made by Mr. Chandratre, Petition is allowed to be withdrawn and is dismissed as withdrawn. Order accordingly.
