Heard the learned Advocates appearing for the parties and the following order is passed by consent :

i.

The Industrial Court, Pune shall frame the following issue as a preliminary issue in Complaint (IT) No. 1 of 2017 in Reference (IT) No. 9 of 2017 : Whether the Complaint is maintainable in law ? ii.

The Member, Industrial Court, Pune shall decide the said issue within a period of 16 weeks from the date of this order. iii.

Parties and / or their Advocates shall appear before the Industrial Court, Pune on 22 nd November, 2017 at 11.00 a.m. and obtain necessary directions. iv.

The Industrial Court, Pune shall not grant any adjournment to the parties and / or their Advocates unless absolutely necessary.

All contentions of the parties are kept open. vi.
