IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO.4039 OF 2016 Shravan Ananta Pawar .... Petitioner V/s.
The Senior Inspector and ors .... Respondents Mr. D. S. Mhaispurkar i/by S. M. Mangaonkar, for the Petitioner.
Mrs. A.S. Pai, APP for the Respondent State. CORAM : RANJIT MORE & DR. SHALINI PHANSALKAR-JOSHI, JJ.
DATE : 8th DECEMBER, 2016.
P.C. :
1.
Heard learned counsel for the petitioner and learned APP for the State.
2.
This petition is filed seeking direction to respondents to register offence on the basis of complaint dated 09.06.2015. It is alleged that the respondent No.4 prepared bogus death certificate, power of attorney and sale deed with the help of fictitious persons. The learned APP submits that respondent No.4 has already expired on 27.01.2016 and this fact is not disputed by learned counsel for petitioner. 3.
Learned counsel for the petitioner, however, submits that the 1/2
907 WP 4039 OF 2016.doc offence is not committed only by respondent No.4 and there is involvement of others and therefore, complaint is required to be registered and enquiry is to be made.
4.
Learned APP, on instructions, submits that the Officer makes statement that the said complaint of petitioner would be looked into by making preliminary enquiry and appropriate decision would be taken and the same shall be communicated to the petitioner within a period of 7 days from the date of receipt of this order. Statement is accepted. 5.
In the light of above statement, in our view, the grievance of the petitioner no more survives and the petition is disposed of accordingly.
