After hearing for some time, both the counsel submitted minutes of order. Same is taken on record and marked 'X' for identification which reads thus:

" MINUTES OF ORDER 1) By consent of both the parties order dated 04/09/2018 passed below Exh-32 in Regular Civil Suit No.213 of 2012 by Civil Judge, Junior Division, Igatpuri, District Nashik is quashed and set aside. Mohite 1/2

904 wpst30019-18.doc 2) Application at Exh-32 in Regular Civil Suit No.213 of 2012 is hereby allowed subject to cost of Rs.10,000/- (Rupees Ten Thousand Only) to be paid to the Respondent or to be deposited before the Ld. Trial Court on the next date, with liberty to the Respondent to withdraw the same.

3) Petitioner undertakes to cross-examine Plaintiff's witness on the next date i.e. 08/02/2019.

4) Trial Court shall hear the Regular Civil Suit No.213 of 2012 expeditiously and to dispose the same on or before 31/12/2019."

Same is accepted.

Writ Petition stands disposed of in terms of minutes of order.
