Heard learned counsel for the parties.

2) This application is preferred by defendant no. 1 for extension of time to comply the order dated 04/07/2014 passed by this court in civil application stamp no. 17480 of 2014 i.e. to extend the time for depositing Rs. 34,000/- along with 10% interest. 3) Learned counsel appearing on behalf of respondent no. 1 filed affidavit of reply dated 16/12/2015 to oppose the present civil application. Advocate for respondent no. 1 submits that applicant failed to make out sufficient cause for extension of time to comply the order passed by this court. Hence, there is no substance in the present civil application and same to be dismissed with cost. ism 1/2

15.377.15 caf.doc 4) Considering the submissions made by learned counsel for the applicant and averments in civil application, particularly in para 7 & 8, I am satisfied that applicant has made out a case for extension of time to comply the order dated 04/07/2014.

5) Hence, following order.

(i) Time to comply the order dated 04/07/2014 is extended till 03/03/2016.

(ii) If applicant fails to comply the order dated 04/07/2014 on or before 03/03/2016, present civil application stand dismissed without referring back to the court.

(iii) The amount to be deposited in Trial Court.

(iv) Civil Application stands disposed of accordingly. (v) Parties to act on copy of this order duly authenticated by Sheristedar of this Court.
