Leave to amend to correct the name of Applicant No.2 as Rupali Shangar Bhingardive.

Learned APP, on instructions from the oficer who is present in the Court submits that in view of the health condition of Application No.1, police do not intend to subject Applicant No.1 to custody. Applicant No.1 is aged about 60 years. Heard learned Advocate in support of Application by Applicant No.2.

rpa 2/2 906-aba-2414-19.doc Since the Court was not inclined to grant relief, the learned Advocate for Applicant on instructions submitted that the Application on behalf of Applicant No.2 is not pressed. In view of the aforesaid circumstances, Applicant No.1 can be protected by way of relief under Section 438 of Cr.P.C.

Hence, I pass the following order:

:: O R D E R ::

(i) In the event of arrest of the Applicant No.1in connection with C.R.No.211 of 2017, registered with Vaduj Police Station, Satara, the Applicant No.1 be released on bail on his furnishing PR Bond in the sum of Rs.20,000/-, with one or more sureties in the like amount;

(ii) Application of Applicant No.2 is not pressed and hence dismissed as withdrawn;

(iii) Anticipatory Bail Application stands disposed of accordingly.
