This is an Application for condonation of delay of 3 years and 48 days in preferring present Appeal against the conviction of Applicant/Appellant.

Mr. Warunjikar, learned Advocate appointed to represent Applicant/Appellant submitted that, since the date of his arrest in the year 2017, Applicant is behind bars. That, after pronouncement of the impugned Judgment and Order, for want of financial aid and legal assistance, the Applicant could not prefer Appeal immediately before this Court within a period of limitation.

It is submitted that, the Applicant thereafter, sent a letter to the Legal Aid Committee, High Court Mumbai through Jail, who inter-alia appointed Advocate Dr. Uday Warunjikar by its appointment Order dated 5th January, 2022.
