This writ petition challenges an order passed by the District Court at Kalyan confirming an order passed by Civil Judge, Junior Division, Ulhasnagar in Regular Civil Suit No.320 of 2010. The impugned orders of the courts below were for interlocutory relief in the civil suit. Learned Counsel for the Petitioner informs the court that during the pendency of the petition, his client's suit has been decreed in his favour and that accordingly, the writ petition does not survive. The writ petition, accordingly, is disposed of as infructuous. It is made clear that the petition is disposed of only on the ground that it has become infructuous as a result of the decree passed in the Petitioner's favour. All rights and contentions of the parties on merits are kept open. (S.C. GUPTE, J.)
